Article 1. Definitions

1. General Terms and Conditions: this document, including any updates or amendments.
2. Cargoroo by MOBY: the trade name of Moby Bikes Netherlands B.V., registered at Prins Hendrikkade 21-E, 1012 TL Amsterdam, the Netherlands.
3. Service(s): the use of Cargoroo by MOBY's shared mobility platform through which users can rent electric cargo bikes for a limited time.
4. User: any natural person or legal entity registered with Cargoroo by MOBY who has entered into an Agreement to use the Services. Users must be at least 18 years old.
5. Shared Vehicle: any electric cargo bike offered through the Cargoroo by MOBY app.
6. Cargoroo by MOBY App: the official mobile application that enables registration, booking, and use of the Service.
7. Shared Area: the geographical area in which Cargoroo by Moby is active, the Shared Vehicle may be rented and returned.
8. Agreement: the contract established between the User and Cargoroo by MOBY when the User successfully registers in the app.

Article 2. Applicability and Interpretation

1. These General Terms and Conditions apply to every registration, reservation, and use of the Services.
2. By registering in the Cargoroo by MOBY app, the User accepts these Terms and Conditions and the Privacy Policy.
3. In case of conflict between these Terms and any promotional or product-specific terms, the most favourable condition for the User applies.
4. Cargoroo by MOBY may modify these Terms as described in Article 12.

Article 3. Establishment of the Agreement

1. The Agreement is established when the User completes registration in the Cargoroo by MOBY app, provides all required information, and links a valid payment method.
2. The User agrees that communication may occur electronically via the app or registered email address.
3. The User must ensure that all information provided (including payment data) is correct and up to date.

Article 4. Use of the Services

1. After successful registration, the User may reserve and unlock a Shared Vehicle via the app.
2. Reservations and rentals are confirmed through the app. A reservation expires if the User fails to unlock the bike within the indicated time.
3. Before starting a ride, the User must check the bike for visible damage or defects and confirm the bike's condition.
4. If a problem is found, the User must not ride the bike and must report the issue via the app.
5. The ride starts when the lock is opened and ends only when the User:
   • parks the bike within the Shared Area;
   • locks it correctly;
   • and ends the ride in the app and receives confirmation within the app.
6. The User is responsible for the bike until the end-of-ride confirmation appears.
7. Cargoroo by MOBY reserves the right to deny a rental if no bikes are available or if there is reasonable cause to refuse use.
8. Each ride may last a maximum of 24 consecutive hours.

Article 5. Duration and Termination

1. The Agreement remains in force indefinitely until terminated by either party.
2. Both the User and Cargoroo by MOBY may terminate the Agreement at any time with one month's notice.
3. Immediate termination without notice is possible if:
   • the User breaches these Terms;
   • payment obligations are not met;
   • the User shares their account with others; or
   • the User operates a Shared Vehicle unsafely or unlawfully.
4. Obligations such as payment of outstanding amounts continue after termination.

Article 6. Price and Payment

1. Current rates are displayed in the app and include VAT unless stated otherwise.
2. Cargoroo by MOBY supports both direct pay-per-ride and wallet-based prepayment (wallet-based rides are subject to a secondary backup method being available in app)
3. Wallet balances are stored under "My Wallet" in the app and may include promotional (bonus) credit.
4. Wallet balances are non-interest bearing and valid for two years after the last top-up.
5. Refunds or withdrawals from the wallet may include administrative costs as listed in the Annex.
6. Unused bonus credits expire after two years and cannot be converted.
7. The User authorizes Cargoroo by MOBY to automatically collect payments for rides, fines, and damages via the linked payment method.
8. In case of non-payment, Cargoroo by MOBY may charge additional administrative and collection costs as permitted by law.

Article 7. User Obligations

1. The User must inspect the Shared Vehicle before each ride.
2. The User is responsible for any damage, fines, or losses occurring during their rental period.
3. The User must obey all traffic laws and behave as a responsible road user.
4. The maximum load of the cargo bike is 140 kg, including passengers and cargo.
5. The User must not exceed 25 km/h or ride under the influence of alcohol or drugs.
6. Only one additional passenger aged 12 or older may accompany the User, within the maximum load.
7. The bike must be properly parked, locked, and left tidy after use in the original designated parking spot.
8. Any misuse, modification, or third-party use of the Shared Vehicle is prohibited.
9. Theft, vandalism, or damage must be reported immediately via the app. In case of theft, a police report must be filed within 24 hours.

Article 8. Liability

1. Cargoroo by MOBY maintains its fleet to be roadworthy but cannot prevent damage caused by third parties.
2. Users remain liable for all damage, theft, or fines incurred during their rental period unless caused by proven technical failure.
3. Cargoroo by MOBY may take out theft insurance, which applies only if the bike was properly locked.
4. Users indemnify Cargoroo by MOBY from third-party claims resulting from improper use.
5. Cargoroo by MOBY is not liable for indirect, consequential, or incidental damages unless caused by intent or gross negligence.
6. In case of force majeure (e.g., technical malfunctions, network failures), Cargoroo by MOBY is not liable for unavailability of Services or any further costs incurred.

Article 9. Use of the App

1. Access to the Services requires the use of the Cargoroo by MOBY app.
2. Users must keep their login credentials secure and confidential.
3. The app must only be used as intended — modifying, copying, or reverse-engineering it is prohibited.
4. Users are responsible for maintaining a charged phone and mobile data to start and end rides.
5. Any irregularities in the app or account must be reported within 24 hours.

Article 10. Data Protection

1. Cargoroo by MOBY processes personal data in accordance with its Privacy Policy and the General Data Protection Regulation (GDPR).
2. The Privacy Policy is available in the app and on the website.
3. The User consents to necessary data processing for the operation of the Service.

Article 11. Right of Withdrawal

1. The User may withdraw from the Agreement within 14 calendar days after registration, provided no ride has taken place.
2. If Services have already been used during this period, only the unused portion of wallet credit may be refunded, less applicable administrative fees, costs, fines or damages resulting from the use of the service.

Article 12. Amendments

1. Cargoroo by MOBY may amend these Terms at any time.
2. Changes will be communicated via the app or official website.
3. Non-material or legally required updates may take effect immediately.
4. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

Article 13. Final Provisions

1. Dutch law applies to these Terms and the Agreement.
2. Disputes shall be submitted to the competent court in Amsterdam, unless mandatory law provides otherwise.
3. If any clause is deemed invalid, the remaining provisions remain enforceable.
4. Cargoroo by MOBY may transfer its rights and obligations to an affiliated entity within the MOBY group.

• Controleer altijd de bakfiets op schade vóór je rit.

Artikel 1. Definities

1. Algemene Voorwaarden: dit document, inclusief eventuele updates of wijzigingen.
2. Cargoroo by MOBY: de handelsnaam van Moby Bikes Netherlands B.V., gevestigd aan Prins Hendrikkade 21-E, 1012 TL Amsterdam, Nederland.
3. Dienst(en): het gebruik van het deelmobiliteitsplatform van Cargoroo by MOBY, waarmee gebruikers elektrische bakfietsen voor een beperkte tijd kunnen huren.
4. Gebruiker: iedere natuurlijke persoon of rechtspersoon die geregistreerd is bij Cargoroo by MOBY en een Overeenkomst is aangegaan om de Diensten te gebruiken. Gebruikers moeten minimaal 18 jaar oud zijn.
5. Deelvoertuig: elke elektrische bakfiets die via de Cargoroo by MOBY-app wordt aangeboden.
6. Cargoroo by MOBY-app: de officiële mobiele applicatie waarmee registratie, reservering en gebruik van de Dienst mogelijk zijn.
7. Deelgebied: het geografische gebied waarin Cargoroo by Moby actief is waarbinnen het deelvoertuig mag worden gehuurd en teruggebracht.
8. Overeenkomst: het contract dat tot stand komt tussen de Gebruiker en Cargoroo by MOBY zodra de Gebruiker zich met succes heeft geregistreerd in de app.

Artikel 2. Toepasselijkheid en Interpretatie

1. Deze Algemene Voorwaarden zijn van toepassing op iedere registratie, reservering en gebruik van de Diensten.
2. Door registratie in de Cargoroo by MOBY-app accepteert de Gebruiker deze Voorwaarden en het Privacybeleid.
3. Bij tegenstrijdigheid tussen deze Voorwaarden en promotionele of productspecifieke voorwaarden geldt de voor de Gebruiker meest gunstige bepaling.
4. Cargoroo by MOBY kan deze Voorwaarden wijzigen zoals beschreven in Artikel 12.

Artikel 3. Totstandkoming van de Overeenkomst

1. De Overeenkomst komt tot stand wanneer de Gebruiker de registratie in de app voltooit, alle vereiste gegevens verstrekt en een geldig betaalmiddel koppelt.
2. De Gebruiker stemt ermee in dat communicatie elektronisch kan plaatsvinden via de app of het geregistreerde e-mailadres.
3. De Gebruiker is verantwoordelijk voor het juist en actueel houden van alle verstrekte gegevens (inclusief betaalinformatie).

Artikel 4. Gebruik van de Diensten

1. Na succesvolle registratie kan de Gebruiker via de app een Deelvoertuig reserveren en ontgrendelen.
2. Reserveringen en huurtransacties worden bevestigd via de app. Een reservering vervalt als de Gebruiker de fiets niet binnen de aangegeven tijd ontgrendelt.
3. Voor aanvang van de rit moet de Gebruiker de fiets controleren op zichtbare schade of gebreken en de staat bevestigen in de app.
4. Indien er een probleem wordt vastgesteld, mag de Gebruiker de fiets niet gebruiken en moet dit via de app worden gemeld.
5. De rit start zodra het slot wordt geopend en eindigt pas wanneer de Gebruiker:
   • de fiets binnen het Deelgebied parkeert;
   • deze correct vergrendelt;
   • En de rit beëindigt wordt in de app en een bevestiging ontvangt in de app.
6. De Gebruiker is verantwoordelijk voor de fiets totdat de bevestiging van ritbeëindiging verschijnt.
7. Cargoroo by MOBY behoudt zich het recht voor om een huur te weigeren als er geen fietsen beschikbaar zijn of als er een redelijke grond is om gebruik te weigeren.
8. Elke rit mag maximaal 24 opeenvolgende uren duren.

Artikel 5. Duur en Beëindiging

1. De Overeenkomst blijft voor onbepaalde tijd van kracht totdat deze door een van beide partijen wordt beëindigd.
2. Zowel de Gebruiker als Cargoroo by MOBY kunnen de Overeenkomst op elk moment met een opzegtermijn van één maand beëindigen.
3. Onmiddellijke beëindiging zonder opzegtermijn is mogelijk indien:
   • de Gebruiker deze Voorwaarden schendt;
   • betalingsverplichtingen niet worden nagekomen;
   • de Gebruiker zijn account met anderen deelt; of
   • de Gebruiker het Deelvoertuig onveilig of onrechtmatig gebruikt.
4. Verplichtingen zoals betaling van openstaande bedragen blijven gelden na beëindiging.

Artikel 6. Tarieven en Betaling

1. Actuele tarieven worden weergegeven in de app en zijn inclusief btw, tenzij anders vermeld.
2. Cargoroo by MOBY ondersteunt zowel directe betaling per rit als vooraf betalen via een wallet (voor wallet-gebruik is een back-up betaalmethode vereist).
3. Het wallet saldo is zichtbaar onder "Mijn Wallet" in de app en kan ook promotionele (bonus)tegoeden bevatten.
4. Het wallet saldo brengt geen rente op, is niet overdraagbaar en blijft twee jaar geldig na de meest recente opwaardering.
5. Terugbetalingen of opnames uit de wallet kunnen administratieve kosten met zich meebrengen, zoals vermeld in de Bijlage.
6. Ongebruikte bonustegoeden vervallen na twee jaar en kunnen niet worden omgezet.
7. De Gebruiker machtigt Cargoroo by MOBY om betalingen voor ritten, boetes en schade automatisch te innen via het gekoppelde betaalmiddel.
8. Bij niet-betaling kan Cargoroo by MOBY extra administratieve- en incassokosten in rekening brengen zoals wettelijk toegestaan.

Artikel 7. Verplichtingen van de Gebruiker

1. De Gebruiker moet het Deelvoertuig vóór elke rit inspecteren.
2. De Gebruiker is verantwoordelijk voor schade, boetes of verliezen die tijdens de huurperiode ontstaan.
3. De Gebruiker moet alle verkeersregels naleven en zich verantwoordelijk gedragen in het verkeer.
4. De maximale belasting van de bakfiets bedraagt 140 kg, inclusief passagiers en lading.
5. De Gebruiker mag niet sneller rijden dan 25 km/u en niet rijden onder invloed van alcohol of drugs.
6. Slechts één extra passagier van 12 jaar of ouder mag mee, binnen de maximale belasting.
7. Na gebruik moet de fiets correct worden geparkeerd, vergrendeld en netjes worden achtergelaten op de daarvoor aangewezen parkeerplek.
8. Misbruik, aanpassing of gebruik door derden is verboden.
9. Diefstal, vandalisme of schade moeten onmiddellijk via de app worden gemeld. In geval van diefstal moet binnen 24 uur aangifte bij de politie worden gedaan.

Artikel 8. Aansprakelijkheid

1. Cargoroo by MOBY onderhoudt haar vloot in verkeersveilige staat, maar kan schade door derden niet altijd voorkomen.
2. Gebruikers blijven aansprakelijk voor schade, diefstal of boetes tijdens de huurperiode, tenzij dit aantoonbaar het gevolg is van een technisch defect.
3. Cargoroo by MOBY kan een diefstalverzekering afsluiten, die alleen geldt als de fiets correct is vergrendeld.
4. Gebruikers vrijwaren Cargoroo by MOBY van aanspraken van derden voortvloeiend uit onjuist gebruik.
5. Cargoroo by MOBY is niet aansprakelijk voor indirecte, gevolg- of incidentele schade, tenzij veroorzaakt door opzet of grove nalatigheid.
6. In geval van overmacht (zoals technische storingen of netwerkproblemen) is Cargoroo by MOBY niet aansprakelijk voor de onbeschikbaarheid van de diensten of voor andere bijkomende kosten.

Artikel 9. Gebruik van de App

1. Toegang tot de Diensten vereist gebruik van de Cargoroo by MOBY-app.
2. Gebruikers moeten hun inloggegevens veilig en vertrouwelijk houden.
3. De app mag uitsluitend worden gebruikt zoals bedoeld — wijzigen, kopiëren of reverse-engineeren is verboden.
4. De Gebruiker is verantwoordelijk voor een opgeladen telefoon en mobiele data om ritten te starten en te beëindigen.
5. Eventuele onregelmatigheden in de app of het account moeten binnen 24 uur worden gemeld.

Artikel 10. Gegevensbescherming

1. Cargoroo by MOBY verwerkt persoonsgegevens in overeenstemming met haar Privacybeleid en de Algemene Verordening Gegevensbescherming (AVG).
2. Het Privacybeleid is beschikbaar in de app en op de website.
3. De Gebruiker stemt in met de noodzakelijke gegevensverwerking voor het uitvoeren van de Dienst.

Artikel 11. Herroepingsrecht

1. De Gebruiker kan de Overeenkomst binnen 14 kalenderdagen na registratie ontbinden, mits er nog geen rit heeft plaatsgevonden.
2. Als de diensten in deze periode al zijn gebruikt, kan alleen het ongebruikte deel van het wallettegoed worden terugbetaald, verminderd met eventuele toepasselijke administratiekosten, kosten, boetes of schade als gevolg van het gebruik van de dienst.

Artikel 12. Wijzigingen

1. Cargoroo by MOBY kan deze voorwaarden te allen tijde wijzigen.
2. Wijzigingen worden gecommuniceerd via de app of de officiële website.
3. Niet-materiële of wettelijk vereiste aanpassingen kunnen onmiddellijk in werking treden.
4. Voortgezet gebruik van de Dienst na de ingangsdatum betekent aanvaarding van de gewijzigde Voorwaarden.

Artikel 13. Slotbepalingen

1. Op deze Voorwaarden en de Overeenkomst is Nederlands recht van toepassing.
2. Geschillen worden voorgelegd aan de bevoegde rechter te Amsterdam, tenzij dwingend recht anders bepaalt.
3. Indien een bepaling ongeldig wordt verklaard, blijven de overige bepalingen onverminderd van kracht.
4. Cargoroo by MOBY mag haar rechten en verplichtingen overdragen aan een verbonden entiteit binnen de MOBY-groep.
